Higgs & Sons' property department is one of the leading providers of commercial property advice in the West Midlands, offering a comprehensive range of services to clients, ranging from large corporations to sole traders.

Within the department, the Property Pension Fund Team provides a dedicated service with specialist expertise in property transactions involving pension schemes (SIPPs and SSASs), including: 

  • Sales and Purchases by SIPPs and SSASs
  • Granting leases by SIPPs and SSASs
  • Secured lending
  • Joint purchase with other pension funds or individuals/companies
  • In specie contributions
  • In specie transfers

We regularly work with the majority of the leading professional trustees. This experience has enabled us to develop an awareness and appreciation of trustees' requirements and concerns when dealing with property which, combined with a thorough understanding of HM Revenue & Custom's pension regulations, gives us specialist expertise in a niche area of property law. 

We also deal with all aspects of Landlord & Tenant law, meaning that we can arrange for leases to be put in place between the pension scheme trustees and the occupying tenant. Our specialist property litigators are also always on hand should disputes arise with tenants.

In addition, we have vast experience in acting for the majority of leading commercial lenders, being instructed by a number of UK clearing banks on a regular basis. Therefore, when borrowing is required to fund an acquisition by a pension fund, we are often able to act for both the lender and the pension scheme trustees, ensuring that the transaction proceeds as smoothly and quickly as possible.

The Property Pension Fund Team works closely with other professionals including financial advisers, accountants and surveyors, and also liaises with colleagues in other departments within the firm to provide a comprehensive service to clients.
