Kids Company case offers a warning to charity sector

Article date:  20/10/2015

As the investigation into children's charity Kids Company gathers pace, a leading expert on charity law will be looking at what lessons can be learned from the situation and how other organisations can avoid making similar mistakes.

Kirsty McEwen, head of Charities and Not for Profit at leading law firm Higgs & Sons, is speaking at 21st Century Risks, a seminar aimed at Trustees, Chief Executives and other charity officers.  Her talk will focus on the failure of high profile charity Kids Company which is currently the subject of a government investigation following its collapse earlier this year.

"The demise of Kids Company was a swift fall from grace, with the organisation now feeling the burden of sustained financial mismanagement and inadequate governance," explains Kirsty who is a leading expert in charity law and an adviser to organisations including the Charity Commission.

"There are many lessons that charity trustees can take from this situation. First and foremost, those responsible for the governance of charities need to be confident enough to challenge, as well as encourage CEO's. This did not appear to be the case at Kids Company."

Kids Company has been the subject of an on-going investigation into its finances and management following its collapse earlier this year. Its profile, in particular that of its former CEO, Camila Batmanghelidjh has ensured the case has remained high on the media agenda over recent months. Alongside financial and leadership misdemeanours, there have also been a number of sexual abuse allegations which both Camila Batmanghelidjh, and the charity's chair of trustees, Alan Yentob have strongly denied.

Kirsty McEwen will be speaking at the 21st Century Risks Seminar - being held at the office of Clement Keys in Birmingham on 20 October. The seminar is aimed at Trustees, Chief Executives, Finance Directors and other charity officers.

Higgs & Sons' Kirsty McEwen is a specialist charities lawyer who has spent many years advising the charities and not for profit sector. She has acted for many well-known and established charities and the Charity Commission.  She regularly writes and speaks on issues affecting the sector.
